Aspects of establishing an operation in China

This seminar provides an overview of the different types of sourcing operations available in China. The speaker will first talk about the primary legal differences between WFOEs, ROs and JVs. Different business strategies require different structures. Additionally some industries are restricted and foreign investment is not always permitted. The second part of the seminar will focus on typical tax and compliance issues which occur when operating these different types of entities in China. Practical examples will illustrate how problems can be avoided when operating in China. In the wake of greater human awareness on environment concerns, the world's environmental legislation is becoming more stringent especially on regulations and directives aimed at hazardous chemicals. Along with the continuous release and renewal of EU & US regulations, a lot of famous brands have even set stricter access criterion on chemical safety. Technical Economic Barriers keep increasing.

This seminar focuses on EU REACH & US RoHS regulations, Halogen Free — the international environmental tendency in E&E production — and the restricted substances that can be found in E&E production for the EU & US markets.

About the speakers

Olaf Griese is the Regional Manager of Dezan Shira & Associates based in Shanghai. He has been living and working in Greater China for more than 8 years. Prior to moving to Shanghai in 2006, Olaf worked for the Dezan Shira office in Beijing after being a researcher at Tsinghua University.

Olaf conducts business structuring work for international companies in Shanghai and the provinces of Jiangsu and Zhejiang. He oversees the firm's regional offices in Hangzhou and Ningbo. He advises on matters of Chinese tax law, operational risk and compliance.

Olaf is a regular contributor to business magazines like China Briefing, Business Forum etc.

Christ Ye is the Technical Services Specialist at the Analytical Testing Department of Bureau Veritas Consumer Products Services based in Shanghai. He is responsible for technical training and consultation services, and develops analytical test solution for electronic & electrical products, food contact materials and other consumer goods in accordance to various International Standards and client specifications. He is also in-charge of quality control inspection and factory audit for Green Product Management System.

Mr. Ye often presents as a speaker at various domestic and international technical seminars. His expertise is on REACH, CPSIA, RoHS, FDA/LFGB, Oeko-Tex etc. He received his Ph. D in Material Science/Nuclear Engineering from China Science and Technology University.

As a seasoned specialist in Sino-foreign economic relations, Christian Groeger draws from over 12 years of China-related experience. As a Client Relationship Manager, he has extensively dealt with multinational corporations and SMEs, identifying needs and developing customized solutions based on their specific strategic and operative requirements.

Before joining Fiducia, Christian headed the Shanghai office of an international personnel development and organizational improvement consultancy and prior to that worked for a Taiwanese non-profit-organization in Hamburg. He received his MBA in International Business with China Focus in a joint-program by Hamburg University and Fudan University. He also studied in Hamburg, Beijing and Kobe for his M.A. in Modern Chinese Studies.

Christian regularly contributes to publications with a China business focus, such as Asia Bridge and Fiducia's China Focus newsletter. Christian speaks fluent Mandarin, English, German and Japanese.

Having faced the China Intellectual Property (IP) and Quality Control monsters early on in his career, Mike Bellamy decided to do something about it by developing the PassageMaker "Black Box Quality Gate" system to extract the best pricing in China and protect IP without compromising quality and service. PassageMaker's 100% US owned and operated Assembly Center in S. China serves as the client's "black box" where inspection, final assembly and branding takes place behind closed doors. In this fashion, Intellectual Property is physically secured and full quality inspection is conducted before product leaves China.

Before organizing PassageMaker, Mike worked with The Brock Group, an international trade and investment consulting firm managed by President Reagan's former US Trade Representative and US Senator Bill Brock in Washington DC. Mike moved to Asia in 1994 and has structured sourcing investments in over 200 production classifications for US and European clients during his time in China. He received his double degrees in Diplomacy and Economics in Washington DC and later went on to gain an International MBA from the University of South Carolina which included a year of full-time graduate level courses at the Harbin Institute of Technology and University of International Business and Economics in Beijing.

Recognized as expert on China sourcing, Mike has been a featured presenter for a number of high profile seminars and trade shows including Global Sources' Global Sourcing Fairs in Hong Kong, Shanghai, and Dubai, Boat Tech China, Rotary Foundation, US Chamber of Commerce, British Chamber of Commerce, National Association of Purchasing Managers/ Institute for Supply Management, Small Business Development Bureau and the State Bar of California among others.
